Policy regarding the protection of your personal data and cookie management
Introduction
CAT LC France attaches great importance to protecting your personal information (hereinafter "Personal Data") and, more generally, to respecting your privacy.
This Policy provides detailed information regarding the protection of your Personal Data by CAT LC France and the management of Cookies. The purpose of this Policy is to inform you about which Personal Data concerning you CAT LC France uses, the reasons why CAT LC France uses and shares these Personal Data, how long CAT LC France keeps them and how you can exercise your rights.

As the data controller, CAT LC France, whose registered office is located at 5-7, rue Frédéric Clavel, 92150 Suresnes (France), is responsible for collecting and processing your Personal Data as part of the services provided by CAT LC France through its website "www.motobycat. com" (hereinafter the "Site"), in accordance with this notice, the relevant laws regarding the protection of personal data, particularly Law n°78-17 of 6 January 1978 concerning data processing, files and civil liberties, and the General Data Protection Regulation ("GDPR").
1. What personal data are processed ?
CAT LC France only collects and uses your Personal Data where this is necessary for the services provided by CAT LC France through its Site.
CAT LC France does not collect unnecessary Personal Data and will only process your Personal Data in the manner specified in this policy.
The provision of Personal Data collected within the framework of the Site for the purposes of the conclusion and performance of the Contract is obligatory, as these Personal Data are essential for making contact, transacting, recording, processing and delivering orders, successfully fulfilling services and issuing invoices.
The failure to provide Personal Data will result in the order being invalid and not accepted.
In the online forms, all fields are mandatory. Failure to fill out these fields will mean that CAT LC France will be unable to provide the service(s) requested.
CAT LC France collects various categories of Personal Data about you, includings :
- Identifying information (e.g. surname, first name, IP address, etc.);
- Contact information (e.g. postal address, email address, telephone number);
- Banking and transactional information (e.g. bank details, credit card number, transaction data); Connection and tracking data (e.g. timestamp, cookies)
- Data relating to your habits and preferences (e.g. data relating to your interactions with CAT LC France, such as Site navigation).
- The Personal Data of a natural person other than the natural person who placed the order through the Site :
When you are not the person handing over the goods to our partner (Collection Point or haulier) or the person accepting the delivery of your goods at the delivery destination, in order to ensure that the service provided runs smoothly, we may ask you to provide us with the following information relating to either of these persons :
- Identifying information (e.g. surname, first name), et
- Contact information (e.g. postal address, email address, telephone number).
In either of these situations, you undertake to inform such person or persons that these Personal Data have been collected.
2. Why (purposes) and on what legal basis do we use your Personal Data?
Depending on the circumstances, CAT LC France may use your Personal Data for the following legal purposes :
- To comply with its legal and regulatory obligations,
- To address issues, remarks and other requests that you wish to submit to CAT LC France via the "contact" form on the Site,
- To open a "Customer Account" on the Site,
- To perform the contract entered into with you,
- To administer and technically manage the Site, its features and services
- To serve its legitimate interests (in particular, proving transactions and defending its rights).
No automated decisions are made by CAT LC France based on Personal Data.
3. To whom may your Personal Data be disclosed ?
CAT LC France only discloses your Personal Data to :
- Employees of CAT LC France in the course of their duties monitoring and supervising the services provided through the Site
- Service providers and subcontractors providing services on our behalf,
- Judicial authorities, state agencies, ombudsmen or public bodies, upon request and to the extent permitted by regulations,
- Those whose profession is regulated, such as lawyers
- Providers who manage cookies and are described in section 8 below, in the event that you accept their cookies.
4. Transfer of Personal Data outside the European Economic Area
CAT LC France may share Personal Data with trusted service providers in order to process, in whole or in part, such Personal Data to the extent necessary to fulfil the tasks entrusted to them (for example, hosting the Site or providing services related to the operation or maintenance of the Site) within or outside of the European Union.
In the event that Personal Data are transferred to a third country outside of the European Union, this transfer shall be carried out in compliance with applicable regulations and in such a way as to ensure adequate data protection either because the Personal Data are being transferred to a country whose level of protection has been deemed adequate by the European Commission, or because our service providers have undertaken to comply with the standard contractual clauses established by the European Commission.
5. For how long are your Personal Data stored ?
Your Personal Data shall be kept for the duration of the contractual relationship and for ten (10) years after the contractual relationship comes to an end.
If you have not placed an order but have provided Personal Data via the contact form or when opening a "Customer Account", your Personal Data shall be kept for a period of ten (10) years, starting from the date on which you provided your Personal Data on the contact form or when you opened an account.
6. What are your rights and how can you exercise them ?
In accordance with applicable regulations, you have the following rights :
- Right to access: you may obtain information about the processing of your Personal Data and a copy of the Personal Data.
- Right to rectification: you may request that your Personal Data be amended where you believe that such Personal Data are inaccurate or incomplete.
- Right to erasure: you may request that your Personal Data be deleted, to the extent permitted by law.
- Right to restrict processing: you may request that the processing of your Personal Data be restricted, to the extent permitted by law.
- Right of objection: you may object to the processing of your Personal Data for reasons related to your situation.
- Right of consent withdrawal: if you have consented to the processing of your Personal Data, you may withdraw such consent at any time.
- Right to data portability: In cases provided for by law, you have the right to have your Personal Data provided to CAT LC France returned to you or, where technically possible, transferred to a third party that you have designated.

In any event, a scan or photocopy of your national identity card must be provided for identification purposes.
In the event that requests to exercise these rights are manifestly unfounded or excessive, in particular because of their repetitive character, CAT LC France reserves the right, at its discretion, to refuse to comply with these requests or to seek payment for reasonable fees that take into account the administrative costs of providing the information or communication or taking the action requested.
7. Protective measures and confidentiality
CAT LC France takes everyone's privacy seriously and, as such, ensures that all necessary technical and organisational measures and precautions are taken to preserve the confidentiality and security of Personal Data. CAT LC France makes every effort, consistent with best practice in this area, to protect Personal Data from alteration, disclosure, destruction or unauthorised access.
8. Cookies
A cookie is a text file that may be stored, subject to your choices, in a dedicated space on the hard drive of your device (computer, tablet, smartphone etc.) when you use your browser to access an online service.

Browsing with Firefox: Click on "Tools", then "Options". In "Privacy & Security", deselect "Accept Cookies" ;
Browsing with Google Chrome: Click “Customise and control Google Chrome”, then choose “Preferences”. Under “Privacy”, click “Content Settings” and tick “Block Third-Party Cookies and Site Data”.
Any cookies stored before you configure your browser will still be on your computer, and you can delete these in your browser settings.

Cookies are stored for a maximum of thirteen (13) months.
9. Complaints to the competent supervisory authority
CAT LC France undertakes to process your Personal Data in accordance with this Policy and with the laws and regulations in force concerning data protection.
However, if you wish to lodge a complaint about the processing of your Personal Data or if you are not satisfied with the way in which we have processed it, you have the right to lodge a complaint with the Commission nationale de l'informatique et des libertés ("CNIL" [National Commission on Informatics and Liberty]).

10. Amendments to this notice
CAT LC France may be required to update this Policy on a regular basis, in particular to take into account technological developments and new features that may be offered on the Site.
CAT LC France invites you to read, on a regular basis, the latest version of this Policy on the Site. CAT LC France will inform you of any substantial change to this Policy via the Site.
